You can use the MK Data Hub portal to create a data feed, describe it, upload/update data and access data. By performing one or more of these actions, you agree to the following conditions:
(a) you are the data owner, or you have the permission of the owner (e.g. through a license) to redistribute these data under the terms set in the description,
(b) we can store, process and manipulate these data, as well as to provide access to others, based on the access restrictions defined by you on the MK Data Hub portal, and
(c) we can report on the inclusion of your data in the MK Data Hub to our funders and partners, and to track its usage for the purpose our research. The data you upload on the MK Data Hub portal remains yours, including the dataset description (metadata). You are free to modify or remove the data and metadata at any time, and to make them available to others. In legal terms, you are granting us a non-exclusive, transferable license to the material, and warranting that permission for this licence has been given by the data owner.
Your personal information
Information about yourself, as a data provider, is stored on the MK Data Hub portal. Your email address, password and IP address will only be available to the members of the team operating the MK Data Hub portal. Other personal information, such as your name and the organisation you represent, might be part of the metadata of datasets included in the MK Data Hub portal. It is up to you, as the data provider, to decide whether or not these metadata, including the associated personal information, might be made visible to others.
Privacy and safety
Data privacy is of critical importance to the MK Data Hub portal. The portal includes basic mechanisms that you can use to restrict access to data. We strongly suggest that you do not upload onto the MK Data Hub data of a sensitive nature, especially data that would require compliance with the UK Data Protection Act, while stronger privacy enforcement mechanisms are being developed. It is your responsibility, as the data provider, to ensure that the data you upload to the MK Data Hub complies with relevant Data Protection regulation. We reserve the right to reject, remove access to or delete data if there are seen to represent a risk to security or privacy.
Using information on the MK Data Hub portal
The rights to data and metadata uploaded by users to MK Data Hub portal are owned by those users. You may use these data only in accordance with the terms set by these users (end-user licences). For all other material, including the content and design of the MK Data Hub portal site, all rights are owned or controlled for these purposes by The Open University and other partners of the MK:Smart project.
Our responsibility to you
We will do our best to ensure the MK Data Hub portal is available and operating in a sustained way. We will also take any reasonable action to ensure that users abide by these terms, and that the system is safe to use. However, we cannot guarantee this. In particular, identifications and other information are provided by us and by other partners of the MK:Smart project in good faith, but we cannot guarantee their accuracy. In legal terms, we exclude any warranty, express or implied, as to the quality, accuracy, timeliness, completeness, performance, fitness for a particular purpose of the MK Data Hub portal or any of its contents. We will not be liable for any damages (including without limitation damages for loss of profit, revenue or anticipated savings) arising in contract, tort or otherwise from the use of or inability to use the MK Data Hub portal or any of its contents or from any action taken (or refrained from being taken) as a result of using the MK Datahub or any such contents. We make no warranty that the contents of the MK Data Hub portal are free from infection by viruses or anything else which has contaminating or destructive properties.
